Landlord’s penalty for discrimination still up in the air

A judge still hasn’t decided how much a landlord should pay for refusing to rent to an unmarried interracial couple in 2002, but attorneys for the couple said they thought it should be between $50,000 and $100,000.

In a hearing Monday in Douglas County District Court, attorneys Bruce Plenk and Max Kautsch asked Judge Stephen Six to decide the amount of punitive damages that should be assessed against landlord Rex Youngquist. Plenk and Kautsch are representing the city’s Human Relations and Human Resources department on behalf of Wayne Jackson and Adrianne Morales, a couple denied an apartment in 2002 at Villa 26 Townhomes, 2109 W. 26th St.

A jury found in May that Youngquist committed illegal housing discrimination when his complex manager refused to rent to the couple.

Plenk on Monday asked the judge to award additional sanctions against Youngquist because he has been uncooperative – for example, by refusing to release information about his finances. Plenk alleged Youngquist recently transferred ownership of his two local apartment complexes to a foundation based in Panama as a way to hide his assets.

Plenk said Youngquist owned property including oil wells in Texas, one floor of an apartment building in Panama City, Panama, and two beach houses in Peru.
