Probation ordered in smothering of infant

? A Bonner Springs man who passed out from drinking and smothered the 2-month-old baby he had been trying to comfort has been sentenced to three years probation.

District Judge R. Wayne Lampson did not fully accept a plea bargain Friday when he sentenced Scott Michael Pruitt, 25, to three years in prison and placed him on probation, on the condition he serve the first 15 weekends in jail. The plea bargain, approved by the baby’s mother, called for two years probation.

“If I find out that you are drinking, I am going to send you to prison,” Lampson said.

Just days before he was to stand trial, Pruitt pleaded guilty in January to involuntary manslaughter in the December 2003 death of Anthony David Hernandez. The defense said Pruitt picked up and rocked the crying baby because others, including the child’s mother, were incapacitated. Pruitt had no memory of what happened until Anthony was found dead.
