Commissioners will consider approving a development plan for Park West Gardens, a 70-unit multifamily development that would be located north of Overland Drive between Eisenhower Drive and Queens Road.

Background

The apartment complex will have nine buildings and will include 32 one-bedroom apartments and 38 two-bedroom apartments. Lawrence-Douglas County Planning Commissioners previously approved the plan on a 9-1 vote. The only dissenting vote was related to where certain trees should be placed as part of the development’s landscape plan.

¢ approve minutes of June 28 City Commission meeting.

¢ approve all claims.

¢ approve drinking establishment license for Pancho’s Mexican Restaurant, 711 W. 23rd St., and retail liquor licenses for Ray’s Wine & Spirits, 721 Wakarusa Drive, and Ray’s Liquor Warehouse, 1215 W. Sixth St.

¢ approve appointments as recommended by the mayor.

¢ bid and purchase items:

a.) authorize the city manager to enter into a contract with Professional Engineering Consultants for the Westwood Hills and Bauer Brook Estates Sanitary Sewer Study in the amount of $17,849.

b.) authorize the rejection of the bid received for certain airport improvement projects. Agree to rebid the projects at a later date in 2006.

¢ adopt on second and final reading:

a.) an ordinance exempting from ad valorem taxation 55 percent of the appraised valuation of certain building expansion improvements and new machinery at Prosoco Inc., 3741 Greenway Circle. The exemption is for a 10-year period.

b.) an ordinance exempting from ad valorem taxation 80 percent of the appraised valuation of new construction and machinery at Serologicals Corp., 3780 Greenway Circle. The exemption is for a 10 year period.

c.) an ordinance designating as a landmark on the Lawrence Register of Historic Places the Zinn-Burroughs house at 1927 Learnard Ave.

d.) an ordinance amending the city’s animal control laws concerning cruelty to animals.

e.) an ordinance relating to the hunting and trapping of animals in parks, recreation or open space areas owned by the city.

f.) an ordinance establishing the public offense of aggressive panhandling.

g.) an ordinance amending uses of the city’s right-of-way, including regulations related to sitting or laying on the sidewalk.

h.) an ordinance amending the definition of criminal trespass to include the unauthorized presence of a person on the roof of a building.

¢ adopt findings of fact and approve requests for:

a.) rezoning of 1.004 acres from M-1 research industrial to RO-2 residential office. The property is located between East 19th Street and Homewood Street east of Bullene Avenue.

b.) rezoning 4.9 acres from A agriculture to RS-2 single family. The property is generally located south of Sixth Street and west of Stonecreek Drive, extended.

c.) rezoning 7.4 acres from A agriculture to RM-1 multifamily. The property is generally located south of Sixth Street and west of Stonecreek Drive, extended.

d.) rezoning 4.2 acres from A agriculture to RM-2 residential office. The property is generally located south of Sixth Street and west of Stonecreek Drive, extended.

¢ approve a use permitted upon review for the co-location and expansion of the equipment building for a wireless communications tower at 4700 Overland Drive.

¢ receive city manager’s report.
