Witness says defendant climbed in through window

On Feb. 16, 2003, the woman’s fears came true: She awoke early in the morning, she said, and saw a man whom she claims had been stalking her climbing through her window.

He was wearing all black, she said. She screamed. Her phone was dead. He ripped a ski mask off his head, pinned her on a bed, told her the police weren’t coming, called her his wife and begged her to “come back to reality” about their relationship.

“He completely overpowered me. I knew I was in trouble,” she said.

After about an hour and a half, he agreed to leave, and she called police.

At least that’s the version of events the woman gave Tuesday when she took the stand in the trial of Dale E. McCormick, 32, on aggravated burglary and aggravated kidnapping charges.

McCormick — an outspoken police critic known for videotaping cops while cursing at them — is serving as his own attorney in the trial, which began Monday.

He claims the woman has multiple personalities and that he entered her home through the front door that night because she invited him. He argues that the two had been intimate friends until she started filing false police reports against him several years ago.

During cross-examination, McCormick asked the woman about details of their earlier friendship, and he suggested she had written in the past that she worried about him breaking into her home and raping her.

However, the trial recessed before McCormick could cross-examine the woman about Feb. 16.

Earlier Tuesday, McCormick cross-examined a police officer about photos of the window taken outside the home shortly after the alleged crime. McCormick has alleged police fabricated scrapes in the window paint because he says some photos show the scrapes but others don’t.

Officer Tony Garcia agreed with McCormick that some of the photos don’t appear to show the scrapes, but he said it was hard to tell because the scrapes are small.

The trial is expected to last two weeks.
