Restitution ruling appealed in sheriff case

? The Kansas attorney general’s office is appealing a ruling that tossed out part of a criminal sentence that ordered former Reno County Sheriff Larry Leslie and Hutchinson attorney Gerald Hertach to pay $750,000 in restitution.

Senior Judge Michael Barbara ruled last month that Leslie and Hertach do not have to pay the restitution, saying the year in jail each served fit the crime.

Prosecutors accused Leslie of accepting about $285,000 from Hertach in exchange for his influence over the Reno County Commission’s decision to contract with Hertach’s company, MgtGp Inc., which operated a privately owned jail annex for four years.

The men pleaded guilty in October to two misdemeanor counts of participation in a prohibited contract.
