Couple, baby sitter will be tried together in child’s suffocation

? Christy Edgar will stand trial with her husband and her children’s baby sitter in the abuse death of the couple’s adopted son.

A Johnson County District Court judge ruled Monday that Christy Ed-gar’s argument that she couldn’t get a fair trial if she were tried with her husband, Neil Edgar, was not strong enough to warrant separate trials.

The Edgars and baby sitter Chasity Boyd, 19, are charged with first-degree felony murder in Brian Edgar’s Dec. 30 death.

The Edgars are pastors of God’s Christian Outreach Ministry; Boyd is a member of the church. Five other church members face charges of abusing the Edgars’ children.

Christy Edgar and Boyd allegedly wrapped Brian from head to toe in duct tape because he had stolen food, according to preliminary hearing testimony.

Neil Edgar has not been directly implicated in the abuse that caused Brian’s death, though Dist. Atty. Paul Morrison argued he allowed it to take place and offered assistance.

Neil Edgar’s lawyer, in an earlier court appearance, said his client would be implicating Christy Edgar and Boyd in the death of Brian Edgar.

Christy Edgar’s lawyer, Bob Thomas, argued last week that because the Edgars would use “antagonistic” defenses, they should be tried separately.

Thomas also pointed out that Neil Edgar told police he was the only one responsible for the abuse that led to Brian Edgar’s death. Thomas said that statement would be used against Neil Edgar.

Lawyers for both Neil Edgar and Boyd opposed separate trials.

In today’s ruling, District Judge John Bennett said Christy Edgar failed to show how she would suffer “actual prejudice” by a joint trial.

“The fact that Christy Edgar might seek to shift guilt to Neil Edgar is not an antagonistic defense if she claims ignorance of the acts,” Bennett wrote.

A June 23 trial date has been set for the three defendants in Johnson County District Court.
