Judge delays Wal-Mart hearing until July

Douglas County Judge Mike Malone on Tuesday delayed a hearing in the lawsuit challenging the city’s moratorium on construction at Sixth and Wakarusa.

The delay came after attorneys for the plaintiff, 6Wak Land Investments LLC, the landowners, said they had not had enough time to respond to motions filed Monday by the city.

The city had asked Judge Malone for immediate dismissal of the case and to prohibit questioning into the “mental processes” of Lawrence city commissioners.

“What we do not have is sufficient time to respond to the motion,” said Mary Jo Shaney, a Kansas City, Mo., attorney representing 6Wak. “There’s a big batch of stuff to read, to sift through and hash out.”

Gerald Cooley, the city’s attorney, agreed to the delay.

The hearing was rescheduled for July 17 and 18.
