Giants' Hernandez charged after trying to hit elderly man with golf clubs

? San Francisco Giants pitcher Livan Hernandez has been freed on bond after he was charged with trying to hit an elderly man with several golf clubs during a street fight.

Hernandez posted $10,000 bond and was released from Miami-Dade County jail late Wednesday, state attorney’s office spokesman Ed Griffith said Thursday. He is scheduled for arraignment Jan. 29.

Hernandez was charged with felony aggravated assault after he got into a “violent” scuffle Wednesday with Fernando Martinez, who received a minor cut on the back of his head, according to a witness account cited in a police statement.

The pitcher, who won the 1997 World Series MVP with the Marlins, then went into his car’s trunk and pulled out two to three golf clubs, the unidentified witness told police.

“Not much happened, but someday he might kill someone,” said Martinez, a warehouse owner. “Now I’m going to sue.”

Hernandez’s attorney, Manuel Vazquez, said it was the 65-year-old Martinez who threw a punch at the 27-year-old Hernandez and one of Hernandez’s friends, and that one of the friends pushed Martinez.

“There are a lot of witnesses who said (Hernandez) never touched the guy. I categorically deny he touched the guy,” said Vazquez, who said he will file a criminal complaint against Martinez.

According to Martinez, Hernandez signed a one-year lease at the warehouse with plans to open a car-accessory business. Martinez said Hernandez became confrontational when told he needed a permit.

Dessens, D-backs agree

Phoenix — Right-hander Elmer Dessens and the Arizona Diamondbacks agreed Thursday to a $7.3 million, two-year contract that includes a team option for 2005. Dessens was acquired from the Cincinnati Reds last month in a four-team trade that sent first basemen Erubiel Durazo to the Oakland Athletics. Dessens, 31, had a 3.03 ERA last season, sixth in the National League.
