Decade-old murder case against husband dismissed

— A Finney District Court Judge has tossed out the murder case against a man whose wife disappeared from Garden City a decade ago.

The county attorney's office now has 10 days to appeal Judge Thomas Richardson's decision to dismiss the first-degree murder charge against Manuel Hernandez.

Hernandez was accused of killing his wife, Yolanda, who was 25 when she was last seen near her home the night of Sept. 10, 1992.

Richardson dismissed the murder case after Thursday's preliminary hearing, during which law enforcement officers and family members testified.

According to testimony at the hearing, Manuel Hernandez was the last person seen with his wife, and she has not contacted her family in 10 years. Witnesses also said the couple had an abusive relationship long before Yolanda Hernandez's disappearance.

Manuel Hernandez remains in the Finney County Jail, where he awaits deportation to El Salvador. He is wanted in the Central American country in the 1993 slaying of his nephew.
