Courts: Convicted child molester ordered back to prison

A Lawrence man convicted of molesting his young granddaughter who had cerebral palsy must go back to prison, the Kansas Supreme Court ordered Friday.

William Van Dyke, 78, was granted an appeal bond to leave prison in January. That was after Douglas County Court officials said they couldn’t find paperwork from his civil suit seeking to repeal his criminal sentence. Van Dyke was ordered to spend more than four years in prison.

Douglas County prosecutors contested the appeal bond, asserting that Van Dyke wasn’t in prison because of the civil case and thus shouldn’t be freed.

Appeal: Teen-age sex offender rightly tried as an adult

A Franklin County teen-ager was properly tried as an adult for sexually assaulting a 7-year-old girl in 1998, the Kansas Court of Appeals ruled Friday.

Daniel Hartpence, who was 17 at the time of the offense, pleaded no contest to two counts of aggravated indecent liberties with a child. He was sentenced to 74 months in prison.

The pleas came after a Franklin County judge ordered Hartpence to face adult criminal charges because of his age and the seriousness of the offenses. His attorneys argued he was emotionally and intellectually behind his age-group peers.
