A Topeka man charged in Douglas County District Court with aggravated kidnapping waived his right to a preliminary hearing Friday.

Gary F. Holmes, 52, is one of three men charged with the September 2000 kidnapping of Dale Alan Miller, Topeka. Miller’s body was discovered in April 2001 in a secluded field in rural northwest Douglas County near Lecompton.

The Douglas County Sheriff’s Office and Kansas Bureau of Investigation have been investigating Miller’s death as a homicide, although no one has been charged in the killing. Miller was 35 when he disappeared from his Topeka home.

Holmes is charged with aggravated kidnapping and conspiracy to commit aggravated kidnapping.

During a preliminary hearing a judge determines whether there is enough evidence to order a trial.

During Friday’s hearing before Judge Michael Malone, Douglas County Dist. Atty. Christine Kenney and Holmes’ attorney, Elbridge Griffy, asked that Holmes’ arraignment, which includes entering a formal plea, be delayed for 30 days. Kenney and Griffy said they had “a number of issues” to resolve before the arraignment.

After the hearing, Kenney and Griffy declined to discuss details concerning the case.

Malone set arraignment for 11:45 a.m. Aug. 5.

One of Holmes’ alleged accomplices, Curtis D. Callarman, 23, Topeka, faces the same charges. Callarman is in federal prison serving a 46-month sentence for possession of cocaine. He was sentenced in February 2001.

The second alleged accomplice, Michael W. Reece, 33, Topeka, is in a federal holding facility for probation violation. He is charged with conspiracy to commit aggravated kidnapping.

Holmes is being detained in the Douglas County Jail on $50,000 bond.
