An arrest warrant was ordered Thursday for Kansas University running back Reggie Duncan when he failed to show up in Lawrence Municipal Court.
But Duncan may avoid arrest if he shows up in court at 8 a.m. Tuesday, Municipal Court Supervising Prosecutor Jerry Little said. There may have been some miscommunication between Duncan and his attorney, Ron Schneider, concerning Thursday's court appearance, Little said.
A hearing was to be held on a motion by the municipal prosecutor's office to revoke Duncan's diversion agreement on a shoplifting charge. He entered a diversion program in March 2001 that requires him to obey all laws for a year to have the charge dismissed.
The motion to revoke was filed after Duncan and former Kansas quarterback Mario Kinsey were charged in Douglas County District Court in September 2001 with stealing a KU student's purse. Both pleaded no contest to charges and were placed on probation.
When Duncan failed to show up in Municipal Court Thursday, Judge Randy McGrath ordered a bench warrant for Duncan's arrest. It takes several days, however, for that warrant to be prepared and then signed by the judge, Little said.
That gives Duncan a chance to make Tuesday's appearance, Little said.
Schneider couldn't be reached for comment.
