Teen pleads innocent to fraternity damages

A Lawrence man charged with setting fire to a vacant Kansas University fraternity pleaded innocent Tuesday to breaking out windows at the burned structure.

Thomas Cale Jr., 19, pleaded innocent in Douglas County District Court to one count of misdemeanor criminal damage to Phi Kappa Theta fraternity, 1941 Stewart Ave. He remains in jail on $5,000 bond for a second set of charges arson and burglary in connection with the fire.

A Feb. 28 fire caused about $300,000 in damage to the vacated fraternity. No injuries were reported, but investigators ruled the fire was intentionally set.

Cale's attorney on Tuesday asked District Judge Robert Fairchild to set Cale's hearing on the criminal damage charge far enough in the future to take into account time needed to proceed with the arson case.

A bench trial on the criminal damage charge was set for 9 a.m. May 7. A preliminary hearing on the arson and burglary charges is scheduled Tuesday.
