City to consider property licensing in single-family zones

Bottom Line

Receive draft of ordinance requiring the business licensing of rental properties in single-family zoning districts.

Background

The proposed ordinance is an outgrowth of efforts to limit the number of unrelated residents in single-family rental homes. Proponents say it would allow the city to track violators. Opponents argue that licensing fees would raise rent costs. The fees should be applied to all rental residences in the city, they say, not just those in single-family zones.

Consent agenda

Review and approve minutes of the following city boards: Lawrence City Commission meeting of March 6; Practitioner's Panel meeting of Feb. 15; HAND Advisory Committee meeting of Feb. 8; Historic Resources Commission meeting of Jan. 18; Board of Zoning Appeals meetings of Dec. 7 and Feb. 1; Sign Code Board of Appeals meeting of Jan. 4; and Parks and Recreation Advisory Board meeting of Feb. 13.

Approve all claims.

Approve a drinking establishment license for El Mezcal restaurant, 804 Iowa.

Approve the following bid and purchase items:

Seven notebook computers for the Lawrence Police Department to the low bidder, Trio Technologies, for $21,000.

Backhoe for the utilities department to the low bidder, KAN Equipment, for $30,200.

Set bid date of March 27 for Phase 1 of the overlay and curb repair program.

Purchase of radio equipment in the amount of $25,881 for the Lawrence Police Department. The funds are available from the Local Law Enforcement Block Grant.

Agreement with Dukes Root Control in the amount of $30,000 for 2001 root control program.

Adopt on first reading the following ordinances:

Amending an earlier ordinance annexing the property tract bounded by Clinton Parkway, 27th Street, Crossgate Drive, and Inverness Drive; pursuant to commission direction at the March 6 meeting.

Annexing approximately 20 acres of city-owned property generally located north of Peterson Road, between Folks Road and Queens Road. The Lawrence-Douglas County Planning Commission unanimously recommended annexation.

Adopt on second and final reading the following ordinance:

Declaring Lawrence Avenue within the corporate limits of the city as a major trafficway. This allows for debt financing of improvements and overlay for this street.

Adopt the following resolutions:

Establishing a benefit district for the construction of a box culvert near 27th Street and Crossgate Drive in the amount of $1,300,000.

Authorizing $130,000 for improvements to the intersections of 23rd and Barker streets, and 27th and Iowa streets.

Accept dedication of easements and rights-of-way for the following final plats:

Sunflower Park Addition No. 2, a replat of Tract C of Sunflower Park Addition No. 1. This 72-lot residential subdivision contains 22.89 acres. The property is generally located east of Southwest Junior High School on the east side of Inverness Drive, north of West 27th Street.

Sunflower Park Addition No. 3, a replat of Tract B of Sunflower Park Addition No. 1. This 31-lot residential subdivision contains 10 acres. The property is generally located on the north side of West 27th Street, west of Crossgate Drive.

Enterprise Rent-A-Car Addition, a replat of a part of Block 50, West Lawrence Addition to the city. This one-lot commercial plat contains approximately 9,625 square feet. A public hearing will be held on variance requests for lot size and lot frontage reductions. The property is commonly known as 1717 W. Sixth Street.

Authorize city manager to execute contract with The Peridian Group, for 27th Street and Crossgate Drive box culvert improvements for $85,000. A contract was approved previously for $75,000, but the engineer believes the group has additional work to perform and have requested an increase in its fee.

Authorize city manager to negotiate with Terra Technologies for the engineering design of stormwater improvements at 13th and Oregon streets.

Authorize city manager to negotiate with Bartlett & West for the engineering design of stormwater improvements at 21st and Massachusetts streets.

Authorize city manager to negotiate with Landplan Engineering for the engineering design of 21st Street stormwater improvements.

Authorize city manager to negotiate with Terra Technologies for the engineering design of stormwater improvements at 15th Street and Lawrence Avenue.

Authorize mayor to sign license agreement with Honeywell, allowing construction of nature trail on Honeywell property adjacent to Prairie Park Nature Center.

Authorize mayor to sign releases of mortgage for: Charles Davis, 1301 Conn.; and Mark and Michelle Wilson, 2617 Rawhide Lane.

Hear city manager's report on city's weatherization program.

Regular agenda

Receive draft of ordinance requiring the business licensing of rental properties in single-family zoning districts.

Receive request to annex and rezone 5.61 acres northeast of North Seventh and North streets from agricultural to single-family residential. Tabled by the commission at its Feb. 13 meeting. Consider placement on future agenda for final approval.
