Lawsuit filed against schools

— A third lawsuit filed against Garden City schools claims the district has violated the rights of students with disabilities.

Former student Patrick McMillan, 19, sued the district in Finney County District Court last week claiming it failed to comply with laws guaranteeing him an education and prohibiting discrimination based on disabilities.

McMillan claims he suffered injuries, pain and humiliation as well as damage to his reputation, personal relations and loss of educational benefits.

He is seeking more than $75,000.

His suit joins those filed May 11 by Robert Ledesma through his parents, Zeke and Alice Ledesma of Garden City; and an anonymous suit of Sept. 20.

Grant Griffiths, Clay Center attorney representing all the plaintiffs, said as many as four lawsuits could be filed.

"There is nothing about the volume of these cases (filed) that causes me any concern regarding the school district," said Allen Glendenning, attorney representing the district's employees.
