GUILTY PLEAS ENTERED IN PAYLESS SHOESOURCE ROBBERY

Sentencing for the two men, who agreed to plea bargains with prosecutors, will be held in about a month.

Two Topeka men pled guilty Monday in the August robbery of Payless ShoeSource.

Brian Moeller, 27, and Kevin Miller, 35, told Douglas County District Judge Jack Murphy that they were accepting plea agreements negotiated with the Douglas County District Attorney's office.

Moeller pleaded guilty to robbery; in exchange prosecutors dropped conspiracy-to-commit robbery charges.

Miller pled guilty to attempted robbery and conspiracy to commit robbery and agreed to testify against Moeller if a trial was necessary.

In entering his plea, Moeller admitted taking money from a Payless clerk while threatening her with a gun.

Murphy told Moeller that he faces a sentence ranging between 2 1/2 years and 11 1/3 years for robbery. Moeller told the judge he understood the penalty and the waiver of his rights associated with the agreement.

Miller admitted to attempted robbery and conspiracy to commit robbery. He faces a sentence ranging from 11 months probation to 2 years and 10 months in prison in both charges.

Murphy told the two men he would sentence them after a pre-sentencing investigation was completed in about a month.

Both men were apprehended hours after the robbery occurred on Aug. 6. At the time, police credited witnesses at the scene with providing information leading to the arrests of Moeller and Miller.

It was the second robbery at Payless this summer. It took place about a month after a man robbed the store and raped a clerk.

Terry McIntyre, a 39-year-old Kansas City, Kan., man, awaits trial on charges stemming from that first robbery.
