Burglaries and thefts reported

  • A 20-year-old Lawrence resident reported a golf bag and a set of clubs valued together at $1,120 stolen between 9 p.m. Monday and 2 p.m. Tuesday from a car parked in the 1800 block of Tennessee.
  • A cement saw and cordless drill valued on police report at $1,350 were stolen between 8:30 a.m. and 9 a.m. last Friday from a vehicle in the 1600 block of Tennessee.

District court

Criminal case proceedings

  • Douglas County District Judge Robert Fairchild rescheduled a sentencing modification hearing for James T. Underberg, 56, for April 27. Underberg initially faced five charges of aggravated indecent liberties with a child and two counts of rape from incidents involving 9-, 12- and 13-year-old girls from November 1994 to September 1997. He later reached a plea agreement with the district attorney's office, pleading to three counts of child endangerment. Fairchild sentenced Underberg to one year for each count and ordered him to actually serve one year of his sentence. Underberg's attorney, David Brown, filed a motion to modify the sentence, saying the father of one of the girls made "prejudicial and improper" comments at Underberg's sentencing and tainted his punishment. Brown also said Underberg had complied with conditions of the agreement he worked out with prosecutors. Judges are not bound by plea agreements.
