A man who wants to withdraw his guilty plea in the shooting death of his ex-wife will have a new hearing later this month to decide whether the public defender who originally represented him was ineffective.
Samuel Mutfwang's new attorney, Harry Warren, told District Court Judge Jack Murphy on Monday that he will file an ineffective counsel charge later this week.
Mutfwang, 46, pleaded guilty to unintentional second-degree murder while represented by Ron Evans of the Northeast Kansas Conflicts Office in Topeka. Evans withdrew from the case after Mutfwang made a series of statements about him to Murphy.
Mutfwang had been scheduled to be sentenced last week for the Jan. 30 murder of Cindy Mutfwang.
