A Jefferson County man has been bound over for trial on charges stemming from a Feb. 21 incident in which he was shot after allegedly kicking in the front door of his sister's mobile home.
After a preliminary hearing Tuesday, a Jefferson County judge ruled Michael R. Higgins, 33, Lakeside Village East, Ozawkie, should stand trial on charges of felony criminal threat and misdemeanor criminal damage to property.
Dist. Magistrate Judge Dennis Reiling refused to order that Higgins stand trial on an aggravated burglary charge after finding that prosecutors presented insufficient evidence to establish probable cause to believe that crime had been committed.
Rex Lane, assistant Jefferson County attorney, said Higgins is to appear back in court May 30 for arraignment and trial scheduling.
Sheriff's reports indicate that Higgins' sister shot him twice with a .38-caliber handgun after he kicked in the front door of her home and refused her requests to leave.
