The city of Lawrence is joining Allen Realty Inc. in appealing a court decision involving demolition of a 120-year-old Lawrence church building.

The city filed a notice of appeal late Wednesday in Douglas County District Court over a decision in a lawsuit pitting the Kansas State Historical Society and the Lawrence Preservation Alliance against Allen Realty and the city.

Allen Realty owns the Old English Lutheran Church, 1040 N.H., and is seeking permission to demolish the building. It had received the go-ahead from the city, but Douglas County District Judge Ralph M. King barred the demolition earlier this month.

Roger Brown, an attorney with the city's law firm, said Thursday that although the city did not want to initiate further action in the case, it would join Allen Realty in an appeal.

"It's still up to Allen Realty to lead and pursue the appeal," Brown said. "The city just wanted to keep its options open so it would be able to raise any issues and present any issues it deems necessary in an appeal."
