RESOLUTION 2009-065

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF LEAVENWORTH COUNTY, KANSAS, ADOPTING A SPECIAL DEVELOPMENT DISTRICT TO GOVERN ALL FUTURE DEVELOPMENTS ALONG THE COUNTY ROAD ONE CORRIDOR UNDER THE JURISDICTION OF THE BOARD OF COUNTY COMMISSIONERS, LEAVENWORTH COUNTY, KANSAS.

WHEREAS, the Board of County Commission of Leavenworth County finds that the development of land in the designated corridor will have the greatest chance of returning the substantial public investment if the area is developed with provisions for proper sewer, public water, stormwater management and fire protection improvements; and,

WHEREAS, the Board of Commissioners finds that existing development regulations and construction standards are not sufficient to ensure the greatest public benefit; and the highest and best use of the land within the district; and,

WHEREAS, the Board of County Commission, has determined an appropriate area be designated as Special Development District (SDD) based upon the need for appropriate land use regulations within and the likelihood of development within the area.

NOW BE IT THEREFORE, RESOLVED:
The Special Development District (SDD) is hereby created for the land defined in Figure 2 as "A strip of land 2 miles wide, 1 mile either side of the centerline of County Road 1 as now established, from the Southeast corner of Section 17, Township 12 South, Range 21 East North to the Northeast corner of Section 29, Township 11 South, Range 21 East, and the South half of Section 20, Leavenworth County, Kansas."

ARTICLE 1: COUNTY ROAD 1 SPECIAL DEVELOPMENT DISTRICT REGULATIONS

Section 1. OVERVIEW
The intent and purpose of the Board of County Commissioners is to allow for the continued use of properties within the SDD along County Road One in the same manner that was allowed for on February 8, 2007, subject only to any planning and zoning regulations that would be adopted on a county-wide basis and the minimum 10 acre requirement. Those regulations specific to the SDD would apply to properties only upon development. The Special Development District (SDD) is the area shown in Figure 2. The following criteria shall be applicable for potential future development within the Special Development District. The Comprehensive Plan indicates this area as "Agriculture Preserve" and "Special Plan District".

Section 2. DEFINITIONS
1.Development: any change in the use of land.
2.Special Development District (SDD): an area subject to additional development regulations.

Section 3. MINIMUM ACREAGE
A proposed development within the SDD shall contain not less than 10 acres. See (Article 2: Grandfathering Exceptions) for existing parcels less than 10 acres.

Section 4. REZONING
Any rezoning of the property within the Special Development District shall only be effective after a recommendation by the Planning Commission and approval by the Board of County Commissioners.

Section 5. ACCESS MANAGEMENT
1.No new entrances shall be allowed onto County Road 1.
2.New Agricultural entrances shall be granted for valid agricultural uses (field access, equipment access, etc…) on parcels greater than 40 acres. These access points shall be placed at a location that will be most advantageous to the safe flow of traffic, with greatest sight distance available. The location of this entrance shall be determined by the County Engineer or person on their staff designated to place these entrances.
3.Full Access shall be allowed every ½ mile along County Road 1 with the understanding that any new development would be required to provide an engineering study that will validate the feasibility of that intermediate access point.

Section 6. DIVISION OF PARCELS
The division of property shall not create a parcel less than 10 acres. This includes lot/tract splits, plats, boundary adjustments, etc.

Section 7.
RIGHTS-OF-WAY
Rights-of-way dedication shall be required for future reverse frontage roads along both sides of the County Road 1 Corridor within a 1/4 to 1/2 mile of the roadway. This will be evaluated and required at the time of rezoning or development of any property located within the Special Development District (SDD).

Section 8. PERFORMANCE STANDARDS
These standards shall only be applicable to new developments within the SDD that create a change of use. See Article 1 Section 8 of the approved Special Development District guidelines.

Section 9. SITE DEVELOPMENT PLAN APPROVAL
These standards shall only be applicable to new developments within the SDD that create a change of use. See Article 1 Section 9 of the approved Special Development District guidelines.

Section 10. VARIANCE
An applicant may apply for a variance or a deviation to the proposed SDD guidelines. The Board of County Commission may review and approve a deviation on a case-by-case basis according to the impact the proposed change would cause to the overall district.
In recommending such variance or exception, the Board of County Commission shall find the following:
1.That there are special circumstances or conditions affecting the property
2.That the variance or exception is necessary for the reasonable and acceptable development of the property in question.
3.That the granting of the variance or exception will not be detrimental to the public welfare or injurious to adjacent property.

ARTICLE 2: GRANDFATHERING EXCEPTIONS TO THE CR-1 SPECIAL DEVELOPMENT DISTRICT REGULATIONS

Section 1. GENERAL
The following exceptions to the Special Development District Guidelines for County Road 1 apply to all properties that are currently zoned rural residential within the Special Development District (SDD) that contain less than 10 acres.

Section 2. BUILDING AND REBUILDING
Regulation: A proposed development within the SDD shall contain not less than 10 acres.
Exceptions:
1.A home existing before the creation of the SDD, may be rebuilt after a fire/natural disaster if the property is less than 10 acres provided the requirements (setbacks, lot frontage, zoning etc.) within the County regulations applicable at the time of application are met.
2.Additions may be built onto a home of a property less than 10 acres provided the requirements (setbacks, lot frontage, zoning etc.) within the County regulations applicable at the time of application are met.
3.An accessory building may be built if a property is less than 10 acres provided the requirements (setbacks, lot frontage, zoning etc.) within the County regulations applicable at the time of application are met.
4.An agricultural building may be built as an accessory use on a property less than 10 acres, if there is a residence on the lot.
5.An accessory manufactured home may be added to a property if the property is less than 10 acres, provided the requirements (setbacks, lot frontage, zoning etc.) within the County regulations applicable at the time of application are met. Accessory dwellings are allowed for certain agricultural and family situations.

Section 3. TRANSFER OF OWNERSHIP
Regulation: A proposed development within the SDD shall contain not less than 10 acres.
Exception: An owner of property (within in the SDD) that is less than 10 acres may "always" sell their property. The new owner may build a house on a vacant piece of property, provided the requirements (setbacks, lot frontage, zoning etc.) within the County regulations applicable at the time of application are met.

Section 4. SPECIAL USE PERMIT AND TEMPORARY USE PERMIT
Regulation: A proposed development within the SDD shall contain not less than 10 acres.
Exception: Special Use Permits may be granted for a property less than 10 acres upon review and approval by the Planning Commission and Board of County Commission. Temporary Use Permits may be granted upon review and approval by the Board of County Commission.

Section 5. VARIANCE
An applicant may apply for a variance or a deviation to the proposed SDD guidelines. The Board of County Commission may review and approve a deviation on a case-by-case basis according to the impact the proposed change would cause to the overall district.
In recommending such variance or exception, the Board of County Commissioners shall find the following:
4.That there are special circumstances or conditions affecting the property
5.That the variance or exception is necessary for the reasonable and acceptable development of the property in question.
6.That the granting of the variance or exception will not be detrimental to the public welfare or injurious to adjacent property.

Section 6. ACCESS
Regulation: No new entrances shall be allowed onto County Road 1.
Exceptions:
1.New agricultural entrances may be considered for valid agricultural uses (field access, equipment access, etc…) on parcels greater than 40 acres. These access points shall be placed at a location that will be most advantageous to the safe flow of traffic, with greatest sight distance available. The location of this entrance shall be determined by the County Engineer or person on their staff designated to place these entrances.
2.Existing access points/entrances shall remain.

Section 7. LAND USE
Regulation: The SDD regulations are applicable to future developments within the district boundaries.
Exception: The existing use of the property within the SDD may remain "as is" as long as the property use remains the same as of the date of the adoption of the resolution establishing a Special Development District.

ARTICLE 3: FINANCES

Section 1. GENERAL
Property within the Special Development District will be exempt from charges incurred by development if there is no change of use or actual utilization of the benefit. There shall be no relief from County wide taxes.

An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at City Hall, 321 S Delaware, Tonganoxie KS 66086 and may be examined or copies provided weekdays 8:00 AM to 4:30 PM.

PUBLIC COMMENTS

Any individual, group or agency may submit written comments on the ERR to the City of Tonganoxie, P O Box 326, Tonganoxie, KS 66086. All comments received by February 11, 2010, will be considered by the City of Tonganoxie prior to authorizing submission of a request for release of funds.

RELEASE OF FUNDS

The City of Tonganoxie certifies to the State of Kansas that Michael Vestal, in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The State of Kansas's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Tonganoxie to use HUD/CDBG program funds.

OBJECTIONS TO
RELEASE OF FUNDS

The State of Kansas will accept objections to its release of funds and the grantee's certification for a period of 15 days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of following bases: (a) the certification was not executed by the Certifying Officer of the grantee; (b) the grantee has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approve of a release of funds by the State of Kansas; or (d) another Federal agency acting pursuant of 40 CFR Part 1504 has submitted a written frining that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec.58.76) and shall be addressed to the Kansas Department of Commerce, CDBG Program, 1000 SW Jackson St, Ste #100, Topeka KS 66612. Potential objectors should contact Commerce to verify the actual last day of the objection period.

Lots 6, 7 and 8, Block 5, Fenn's Broadway subdivision, City of Leavenworth, Leavenworth County, Kansas, commonly known as 1926 Cleveland Terrace, Leavenworth, KS 66048 (the "Property")
