NOTICE OF SHERIFF`S SALE

NOTICE IS HEREBY GIVEN, that under and by virtue of an Order of Sale issued by the Clerk of the District Court of Leavenworth County, Kansas, in the case above numbered, wherein the parties above named were respectfully plaintiff and Defendant, and to me, the undersigned Sheriff of Leavenworth County, Kansas, directed, I will offer for sale at public auction and sell to the highest bidder for cash in hand at the Justice Center on the 2nd floor lobby (street level) at 601 S. 3rd Street, Leavenworth on March 25, 2010, at 10:00 a.m. of said day, the following described real estate situated in the County of Leavenworth, State of Kansas, to-wit:

ALL THAT PARCEL OF LAND IN CITY OF LANSING, LEAVENWORTH COUNTY, STATE OF KANSAS, AS MORE FULLY DESCRIBED IN DEED BOOK 979, PAGE 41, ID# 106-24.0-40-05-005-00, BEING KNOWN AND DESIGNATED AS FOLLOWS:

LOT 13, WENDEL REPLAT, A SUBDIVISION IN LANSING, LEAVENWORTH COUNTY, KANSAS, ACCORDING TO THE RECORDED PLAT THEREOF.

BY FEE SIMPLE DEED FROM MARK H. SPALDING AND JANET L. SPALDING, HUSBAND AND WIFE AS SET FORTH IN BOOK 979 PAGE 41 DATED 03/22/2006 AND RECORDED 03/27/2006, LEAVENWORTH COUNTY RECORDS, STATE OF KANSAS ("Property")

said real property is levied upon as the property of Defendant Mark H. Spalding and Janet L. Spalding and all other alleged owners and will be sold without appraisal to satisfy said Order of Sale.
