Ordinance No. 3177

AN ORDINANCE OF THE CITY OF SHAWNEE, KANSAS,
DESIGNATING A PORTION OF CLEAR CREEK PARKWAY
WITHIN THE CITY AS A MAIN TRAFFICWAY PURSUANT
TO K.S.A. 12-685 ET SEQ. (CLEAR CREEK PARKWAY
FROM CLARE ROAD TO K-7 HIGHWAY) AND REPEALING
ORDINANCE NO. 3139

WHEREAS
, K.S.A. 12-685 et seq., authorizes the gov-
erning body of any city to designate and establish by
ordinance as a main trafficway any existing or pro-
posed street, boulevard, avenue or part thereof, within
such city, the primary function of which is, or shall be,
the movement of through traffic between areas of con-
centrated activity within the city or between such areas
within the city and traffic facilities outside the city per-
forming the function of a major trafficway; and
WHEREAS , K.S.A. 12-686 authorizes the governing
body of any city to designate and establish by ordi-
nance as a trafficway connection portions of existing
streets, boulevards, avenues or viaducts as trafficway
connections or to acquire by purchase or condemna-
tion the necessary right-of-way for such purposes and
designate and establish the same as trafficway connec-
tions and to connect any street, boulevard, avenue or
viaduct with any of the main trafficways and/or con-
nect two main trafficways; and
WHEREAS , pursuant to Ordinance No. 3139 of the
city of Shawnee, Kansas (the "City"), passed on Decem-
ber 14, 2015 ("Ordinance No. 3139"), the City has previ-
ously designated certain streets within the City as main
trafficways or trafficway connections; and
WHEREAS, the Governing Body finds it necessary
and desirable to repeal Ordinance No. 3139 and replace
Ordinance No. 3139 with this Ordinance which extends
those main trafficways or trafficway connections origi-
nally designated and corrects an error in Ordinance No.
3139;
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERN-
ING BODY OF THE CITY OF SHAWNEE, KANSAS, AS FOL-
LOWS:
SECTION 1
. Pursuant to K.S.A. 12-685, Clear Creek
Parkway from Clare Road to K-7 Highway is hereby des-
ignated as a main trafficway, the primary function of
which is the movement of through traffic between
areas of concentrated activity within the City and be-
tween such areas within the City and traffic facilities
outside the City.
SECTION 2 . Ordinance No. 3139 is hereby repealed
and replaced by this Ordinance.
SECTION 3 . This Ordinance shall be in full force and
effect after its passage by the Governing Body of the
City and publication one time in the official City news-
paper.
PASSED by the Governing Body this 28th day of Novem-
ber, 2016.
