SECTION XV, ARTICLE 2, SECTION 15-201 WATER AND SEWER REGULATIONS, INCORPORATED BY REFERENCE WITH THE CODE OF THE CITY OF TONGANOXIE ORDINANCE 1197. FURTHER, ARTICLE 1, SECTION 11 AND SECTION 12, OF THE WATER AND SEWER REGULATIONS OF THE CITY OF TONGANOXIE, KANSAS CONCERNING PAYMENT FOR WATER SERVICE CONNECTIONS SHALL BE AMENDED AS FOLLOWS:

Be it ordained by the Governing Body of the City of Tonganoxie, Kansas:

Section 1. That Article 1, Section 11 shall be repealed and the following new Section 11 shall be inserted as adopted:

PAYMENT BY IN TOWN CONSUMERS FOR WATER SERVICE CONNECTIONS: The cost of service connections for consumers within the city limits shall be paid at the time of application. The cost payable under this section shall be as follows:

(A)3/4" service - $2,000.00

(B)The property owner or his contractor is responsible for all costs for meters larger than 3/4". All connections must meet City specifications. The property owner or his contractor must arrange with the City Superintendent for the inspection of the tap before it can be covered.

Section 2. That Article 1, Section 12 shall be repealed and the following new Section 12 shall be inserted as adopted.

PAYMENT BY OUT-OF-TOWN CONSUMERS FOR WATER SERVICE CONNECTIONS: The cost of such service connections for water consumers outside the city limits shall be paid at the time of application. Only residential services that are outside the city limits will be allowed to hook up to the City's water. The cost payable under this section shall be as follows:

(A)3/4" service - $8,000.00

(B)The property owner or his contractor is responsible for all costs for meters larger than 3/4" in addition to the $8,000.00. All connections must meet City specifications. The property owner or his contractor must arrange with the City Superintendent for the inspection of the tap before it can be covered.

(C)A meter reading fee in an amount equal to 25% of the water charge, with a $1.00 minimum, will be added to the bills of out-of-town customers who are connected to the City water services.

Section 2. EFFECTIVE DATE. This Ordinance shall be in full force and effect on and after August 1, 2008.

Section 2. REPEAL. To the extent any other Ordinance of the City of Tonganoxie which is inconsistent or in conflict herewith, the same is repealed.

Section 3. EFFECTIVE DATE. That this ordinance shall take effect and be in force from and after its passage, approval, and publication in the Tonganoxie Mirror, the official newspaper of the City of Tonganoxie, Kansas, but no date earlier than August 1, 2008.

A RESOLUTION LEVYING SPECIAL ASSESSMENTS ON CERTAIN PROPERTY TO PAY THE COSTS OF INTERNAL IMPROVEMENTS IN DOUGLAS COUNTY, KANSAS, AS HERETOFORE AUTHORIZED BY RESOLUTION NO. 07-08 OF THE COUNTY; AND PROVIDING FOR THE COLLECTION OF SUCH SPECIAL ASSESSMENTS.

WHEREAS, the Board of County Commissioners of Douglas County, Kansas (the "County") has heretofore adopted Resolution No. 07-08 (the "Authorizing Resolution"), which authorized the improvement of N 600 Road, from easterly right of way line of E 1700 Road (County Route 1055) to E 1750 Road to County standards with chip sealed aggregate base surfacing and appropriate drainage structure replacementscertain internal improvements (the "Improvements") to be constructed pursuant to K.S.A. 68-728 et seq. (the "Act"); and

WHEREAS, a copy of the Authorizing Resolution has been duly published, recorded with the Register of Deeds of the County and mailed via certified United States mail to each and all owners of property affected by such assessments at the same address as their tax statement is sent and no written protest against the Improvements has been filed with the County Clerk, all in accordance with the provisions of the Act; and

WHEREAS, the Board of County Commissioners has heretofore conducted a public hearing in accordance with the Act and desires to levy assessments on certain property benefited by the construction of the Improvements.

ORDINANCE NO. 2207

AN ORDINANCE AMENDING ARTICLE 5, SECTION 3 OF THE CITY'S ZONING REGULATIONS, CONCERNING SETBACKS FOR SMALL ACCESSORY BUILDINGS

WHEREAS, the Planning Commission recommends that the City's regulations concerning side and rear setbacks for small accessory buildings and playhouses as contained in Article 5, Sections 3.A and 3.B of the Zoning Regulations be amended; and

WHEREAS, all newspaper notifications were performed and a public hearing was properly held before the City Planning Commission.

NOW THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF DE SOTO, KANSAS:

Section 1. That Article 5, Section 3, Subsections A and B of the City's Zoning Regulations be amended to state the following:

A. One structure for storage incidental to a permitted use; provided, however, that no storage structure that is accessory to a residential building shall exceed 200 square feet in gross floor area, the use shall be in keeping with the principal structure, and no part of such structure shall be located in the front, side or rear yard setback for the applicable zoning district, except that the side or rear setback need not exceed 10 feet.

B. One child's playhouse, provided it shall not be more than 120 square fee in gross floor area, and it shall not be located in the front, side or rear yard setback for the applicable zoning district, except that the side or rear setback need not exceed 10 feet.
