The proposed contract documents consisting of the drawings and specifications, together with information for bidders, bid proposal, form and forms of contracts, performance bond and statutory bond, may be examined at the office of BG Consultants, Inc., 1405 Wakarusa Drive in Lawrence, Kansas. The proposed contract documents may be obtained by prospective bidders from BG Consultants, Inc. at a non-refundable cost of $75 for each set.

A Bidder may withdraw any Bid he has submitted at any time prior to the hour for the Closing of the Bids provided the request for withdrawal is signed in a manner identical with Bid being withdrawn. No withdrawal or modification will be permitted after the hour designated for closing Bids. No Bidder may withdraw his proposed Bid for a period of Sixty (60) days after the date and hour set for the opening of Bids.

ORDINANCE NO. 2241

AN ORDINANCE AMENDING ARTICLE 2 AND APPENDIX "A" OF THE CITY'S ZONING REGULATIONS TO IMPLEMENT THE "R-A" RURAL AGRICULTURE ZONING DISTRICT

WHEREAS, the Planning Commission has recommended that certain definitions be included in Section 2, Article 2 of the Zoning Regulations and that certain corrections be made to Appendix "A" in order to properly implement the newly adopted "R-A" Rural Agriculture District; and

WHEREAS, all newspaper notifications were performed and a public hearing was properly held before the City Planning Commission.

NOW THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF DE SOTO, KANSAS:

Section 1. That Section 2 of Article 2 of the City's Zoning Regulations be amended to add the following definitions:

Accessory Dwelling: A dwelling that may be used year round by the owner, manager, guard or caretaker of a facility, but only if such dwelling is required in order to provide needed services such as security, care or maintenance.

Agricultural Accessory Building/Structure: Building or structure used primarily for an agricultural use or accessory agricultural use.

Agriculture/Agricultural Use: The use of land, building(s), or structure(s) for "Agricultural Activity" as defined by K.S.A. 2-3203. Agriculture or Agricultural Use shall not include the operation of a feedlot, the disposal of or feeding of garbage or offal to animals, a slaughterhouse or logging operations.

Archery Range: Facilities that may or may not include structures, for the purpose of discharging or otherwise using archery equipment.

Cemetery: Land and structures used or intended to be used for the burial or interment of the dead, whether human or animal, including mausoleums and mortuaries.

Compost Manufacturing: The process of mixing together natural, organic materials to produce compost. Such process includes the controlled biological decomposition of organic material that has been sanitized through the generation of heat and stabilized to the point that it is beneficial to plant growth.

Crematory: A building or part of a building with a furnace called a retort which is used to cremate (reduce to ashes) remains. This use may be part of a funeral home or mortuary use or it can be an independent business available to the public.

Farm Stand or Produce Stand: An open structure, where agricultural produce or other products of the farm where the stand is located, are sold to the general public by people who reside on the farm.

Feedlot: A limited or confined land area, building or combination of such used for the short term (60-90 days) fattening of livestock for market purposes, and the ratio of livestock ...

ORDINANCE NO. 562

AN ORDINANCE AMENDING ARTICLE 1 OF CHAPTER XV OF THE CITY CODE PERTAINING TO UTILITY SERVICES

WHEREAS, the Governing Body deems it necessary to amend the City Code to set forth new provisions pertaining to collection of delinquent city utility accounts.

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BASEHOR, KANSAS:

SECTION 1: Article 1 of Chapter XV of the City Code is amended to read as follows:

ARTICLE 1. GENERAL PROVISIONS

15-101. DEFINITION. For purposes of this article "utility services" shall include sewer, solid waste (refuse) and other utility services provided by the city. (Code 1989)

15-102. MONTHLY CHARGES. Charges for utility services shall be made each month of the calendar year. All bills are due on or before the close of business on the fifteenth day of the month following the month for which charges are made. The billing date shall be the last day of each month for which charges are made. Past due bills shall accrue a late charge (penalty) of 10% on any unpaid balance.

(a) All utility customers shall be required to complete a "Utility Service Contract" and pay a Processing Fee as set forth in the Fee Schedule prior to using utility services.

(b)Property owners who rent or lease to customers of the city's utility services shall be responsible for advising the Administrative Department of the customers' current address and any changes that may occur from customers moving in or moving out of said address.

(b) Person Responsible for Payment. The rates and charges herein established in the Fee Schedule shall be collected from the customers of the City of Basehor for utility services. Where payment is delinquent and the customer owns the property they shall be responsible for the delinquency. If payment is delinquent and the customer is renting or leasing, they shall be responsible for the delinquency. However, the landlord is ultimately responsible and the delinquency may be pursued through legal action.

15-103. DELINQUENCY AND HEARING. On an annual basis, the City Clerk or designated officer (hereafter referred to as "City Clerk") shall compile a list of all customers who are at least two (2) months delinquent in their utility bill payments. The City Clerk shall prepare a delinquency notice quarterly for each delinquent account, and mail such notice to the customer (and the property owner, if known and different from the customer) at the address shown in the records of the city. JOINT ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, AND RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF DOUGLAS COUNTY, KANSAS AMENDING THE COMPREHENSIVE LAND USE PLAN "HORIZON 2020" BY REPEALING THE "TABLE OF LAND USE CATEGORIES & LOCATIONAL CRITERIA" IN CHAPTER 3 - GENERAL PLAN OVERVIEW.

WHEREAS, pursuant to K.S.A. 12-747, a comprehensive plan or part thereof shall constitute the basis or guide for public action to insure a coordinated and harmonious development or redevelopment which will best promote the health, safety, morals, order, convenience, prosperity and general welfare as well as wise and efficient expenditure of public funds; and WHEREAS, the City Commission of Lawrence, Kansas and the Board of County Commissioners of Douglas County, Kansas has adopted a comprehensive land use plan labeled "Horizon 2020"; and WHEREAS, after due and lawful notice and hearing the Lawrence-Douglas County Metropolitan Planning Commission on September 21, 2009, by Resolution No. PCR-9-5-09, recommended the adoption of the amendment to Chapter 3 - General Plan Overview to repeal the "Table of Land Use Categories & Locational Criteria"; and WHEREAS, a certified copy of the Chapter 3 - General Plan Overview amendment contained in planning staff report CPA-6-3-09 and adopted by the Planning Commission in Resolution No. PCR-9-5-09 on September 21, 2009 together with the written summaries of the public hearings thereon held by the Lawrence-Douglas County Metropolitan Planning Commission on September 21, 2009 has been submitted to the Governing Bodies. NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS; AND BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DOUGLAS COUNTY, KANSAS: Section 1. The above recitals are incorporated by reference as if fully set forth herein and shall be as effective as if repeated verbatim. Section 2. The Governing Bodies of the City of Lawrence, Kansas, and Douglas County, Kansas, hereby find that the provisions of K.S.A. 12-743 and K.S.A. 12-747 concerning the amendment of comprehensive plans has been fully complied with in consideration and adoption of and amendment to "Horizon 2020". Section 3. Pursuant to K.S.A. 12-747, the Governing Bodies of Douglas County, Kansas and the City of Lawrence, Kansas do hereby amend "Horizon 2020" by approving the recommendation of the Planning Commission, and repealing the "Table of Land Use Categories & Locational Criteria" in Chapter 3 - General Plan Overview, contained in and adopted by the Planning Commission in Resolution No. PCR-9-5-09 on September 21, 2009. Section 4. Severability. If any section, clause, sentence, or phrase of this joint ordinance or resolution is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this joint ordinance and resolution. Section 5. This Joint Ordinance and Resolution shall be in full force and effect upon its adoption by the Governing Bodies of the City of Lawrence and Douglas County, Kansas and publication as provided by law.

JOINT ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, AND RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF DOUGLAS COUNTY, KANSAS AMENDING THE COMPREHENSIVE LAND USE PLAN "HORIZON 2020" BY REPEALING CHAPTER 13 AND RESERVING THE SAME FOR FUTURE USE AND ADOPTING CHAPTER 17 - IMPLEMENTATION.

WHEREAS, pursuant to K.S.A. 12-747, a comprehensive plan or part thereof shall constitute the basis or guide for public action to insure a coordinated and harmonious development or redevelopment which will best promote the health, safety, morals, order, convenience, prosperity and general welfare as well as wise and efficient expenditure of public funds; and WHEREAS, the City Commission of Lawrence, Kansas and the Board of County Commissioners of Douglas County, Kansas has adopted a comprehensive land use plan labeled "Horizon 2020"; and WHEREAS, after due and lawful notice and hearing the Lawrence-Douglas County Metropolitan Planning Commission on September 21, 2009, by Resolution No. PCR-9-6-09, recommended the repeal of Chapter 13 and the reservation of the same for future use and the adoption of "Chapter 17 - Implementation"; and WHEREAS, a certified copy of the Chapter 17- Implementation amendment contained in planning staff report CPA-6-4-09 adopted by the Planning Commission in Resolution No. PCR-9-6-09 on September 21, 2009 together with the written summaries of the public hearings thereon held by the Lawrence- Douglas County Metropolitan Planning Commission on September 21, 2009 has been submitted to the Governing Bodies; and WHEREAS, pursuant to the provisions of K.S.A. Chapter 12, Article 7, K.S.A. 12-3009 to and including 12-3012, K.S.A. 12-3301 et seq., the Home Rule Authority of the County as granted by K.S.A. 19-101a, and the Home Rule Authority of the City as granted by Article 12, § 5 of the Constitution of Kansas, the Board and the City are authorized to adopt and amend, by resolution and ordinance, respectively, and by incorporation by reference, planning and zoning laws and regulations.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS; AND BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DOUGLAS COUNTY, KANSAS: Section 1. The above recitals are incorporated by reference as if fully set forth herein and shall be as effective as if repeated verbatim. Section 2. One copy of said plan shall be marked or stamped as "Official Copy as Adopted by Ordinance No. 8464 and Resolution 09-____" and to which shall be attached a copy of this joint resolution and ordinance, and filed with each of the County Clerk and City Clerk, to be open to inspection and available to the public at all reasonable hours. The police department, municipal judge, and all administrative departments of the City charged with the enforcement of the ordinance shall be supplied, at the cost of the city, such number of official copies of such "Chapter 17 - Implementation" marked as may be deemed expedient. Section 5. Severability. If any section, clause, sentence, or phrase of this joint ordinance or resolution is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this joint ordinance and resolution. Section 6. This Joint Ordinance and Resolution shall be in full force and effect upon its adoption by the Governing Bodies of the City of Lawrence and Douglas County, Kansas and publication as provided by law. CHARTER
ORDINANCE NO. 20

A CHARTER ORDINANCE EXEMPTING THE CITY OF TONGANOXIE, KANSAS FROM THE PROVISIONS OF K.S.A. 12-16,128, AND PROVIDING SUBSTITUTE PROVISIONS ON THE SAME SUBJECT.

WHEREAS, The City of Tonganoxie , Kansas is authorized to exercise the powers, functions and duties of a city of the third class, including home-rule powers in the manner, and subject to the limitations, provided by Article 12, Section 5 of the Constitution of the State of Kansas and,

WHEREAS, K.S.A. 12-16,128 was adopted in 2008 as part of an enactment, Chapter 163 of the Session Laws that contained statutes that were non-uniform.

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF TONGANOXIE, KANSAS:

Section 1 Exemption: The City of Tonganoxie, Kansas by virtue of the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to and does exempt itself and make inapplicable to it K.S.A. 12-16,128, which applies to this city but is part of the enactment concerning certain municipalities, as enacted in Chapter 163 of the Session Laws of 2008, which enactment applies to this city but does not apply uniformly to all cities.

Section 2. Publication. This Charter Ordinance shall be published once each week for 2 consecutive weeks in the official city newspaper.

Section 3 Effective date: This Charter Ordinance shall take effect 61 days after the final publication unless a sufficient petition for a referendum is filed, requiring a referendum to be held on the ordinance as provided in Article 12, Section 5 of the Constitution of the State of Kansas, in which case this Charter Ordinance shall become effective upon approval by a majority of the electors voting thereon.

Passed by the governing body, not less than two-thirds of the members voting in favor thereof, the 9th day of November 2009.

Notice is hereby given that under and by virtue of an order of sale issued by the District Court of Douglas County, Kansas, the above captioned action pending in said court, wherein the parties above named were respectively plaintiffs and defendants, and to me, the undersigned Sheriff of said county, directed, I will offer for sale at public auction and sell to the highest bidder for cash in hand on the south steps of the Judicial and Law Enforcement Center, 111 East 11th Street, in the City of Lawrence, in said county, on the 3rd day of December, 2009, at 10:00 A.M. of said day, the following described real estate situated in the County of Douglas, State of Kansas:

A part of the Southwest Quarter of Section 18, Township 14 South, Range 20 East of the 6th P.M., in Douglas County, Kansas, described as follows:

ORDINANCE NO. 8475

AN ORDINANCE REZONING APPROXIMATELY .189 ACRES FROM IG (GENERAL INDUSTRIAL) DISTRICT TO CS (COMMERCIAL STRIP) DISTRICT; AMENDING THE OFFICIAL ZONING DISTRICT MAP INCORPORATED BY REFERENCE IN CHAPTER 20, ARTICLE 1, SECTION 20-108, OF THE "CODE OF THE CITY OF LAWRENCE, KANSAS, 2009 EDITION," AND AMENDMENTS THERETO WHEREAS, Rezoning Application Z-08-12-09 requesting rezoning from IG to CS was filed with the City of Lawrence on August 17, 2009; and
WHEREAS, after due and lawful notice was given pursuant to K.S.A. 12-757 and Section 20-1303 of the "Code of The City of Lawrence, Kansas, 2009 Edition" a public hearing was held by the Lawrence-Douglas County Metropolitan Planning Commission on October 26, 2009 to hear a request to rezone approximately .063 acres as described in Section Two of this ordinance from IG (General Industrial) District to CS (Commercial Strip) District; and WHEREAS, on October 26, 2009 The Lawrence-Douglas County Metropolitan Planning Commission considered the report and recommendation of the City's professional staff, the evidence and testimony provided at the hearing and the review and decision making criteria of section 20-1303 and voted (9 to 0) to recommend approval of the rezoning request; and WHEREAS, the rezoning application and Lawrence-Douglas County Metropolitan Planning Commission recommendation were considered by the Governing Body at the November 10, 2009, meeting. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS: SECTION ONE: The above stated recitals are by reference incorporated herein, and shall be as effective as if repeated verbatim. SECTION TWO: That the zoning district classification for the following legally described tract of land situated in the City of Lawrence, Douglas County, Kansas, to-wit: North Lawrence Subdivision of the South ½ of Block 5, Lots 217, 219 & 221 is hereby changed from IG (General Industrial) District to CS (Commercial Strip) District as such district is defined and prescribed in Chapter 20 of the "Code of the City of Lawrence, Kansas, 2009 Edition," and amendments thereto.SECTION THREE: That the Official Zoning District Map incorporated by reference in and by Chapter 20, Article 1, Section 20-108 of the "Code of the City of Lawrence, Kansas, 2009 Edition" is hereby amended by showing and reflecting thereon the new zoning district classification for the aforesaid tract, as set forth in Section Two of this ordinance. SECTION FOUR: Severability. If any section, clause, sentence, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance. SECTION FIVE: This ordinance shall be in full force and effect from and after its passage and publication as provided by law. You, and each of you are hereby notified that J & J Operating, LLC has filed an application to commence the injection of saltwater into the Squirrel formation at the Kelly (Circle K) Lease: (Kelly (Circle K) I-1), located in the north-half (N/2) of the southeast quarter (SE/4) of Section 31, Township 13, Range 21 East, (Kelco I-1), (Kelco I-2), (Kelco I-3), (Kelco I-4), located in south-half (S/2) of the northeast quarter (NE/4) of Section 31, Township 13, Range 21 East, (Schmidt I-1) located in southeast quarter (SE/4) of the south half (S/2) of the northwest quarter (NW/4) of Section 31, Township 13, Range 21 East, Douglas County, Kansas, with a maximum operating pressure of 650 psig, and a maximum injection rate of 40 bbls per day.

Any persons who object to or protest this application shall be required to file their objections or protest with the Conservation Division of the State Corporation Commission of the State of Kansas within thirty (30) days from the date of this publication.
