parental rights to the child

above has been filed in
this Court requesting the
Court to find the child is a
child in need of care as de-
fined in the Kansas Code
for the Care of Children. If
a child is adjudged to be a
child in need of care and
the Court finds a parent to
be unfit, the Court may
permanently terminate
that parent's parental
rights. The Court may also
make other orders includ-
ing, but not limited to, re-
quiring a parent to pay
child support.

A motion to find the par-
ents of each child named
above unfit and to termi-
nate parental rights, ap-
point a permanent custo-
dian, or enter such orders
as are deemed appropriate
and just has been filed.
The court may enter
orders regarding custody
and case planning neces-
sary to achieve perma-
nency for each child
named above, including
proposals for living ar-
rangements for the child
and services to be pro-
vided the child and the
child's family.

On the 18th day of Decem-
ber, 2017 at 9:00 a.m. each
parent and any other per-
son claiming legal custody
of the minor child is re-
quired to appear for an Ad-
judication and Trial or De-
fault Hearing on the Mo-
tion for Finding of Unfit-
ness in Division 6 at the

grandparent is permitted
but not required to appear

lection of any fees, fines or
costs assessed during Mu-
nicipal Court. This specifi-
cally applies to, but is not
limited to, parking tickets,

ORDINANCE 1071

AN ORDINANCE AMENDING
CHAPTER XV, ARTICLE 10,
SECTION 15-1001 OF THE
CODE OF THE CITY OF EU-
DORA, KANSAS, RELATING
TO UTILITY BILLING.
NOW BE IT ORDAINED BY
THE GOVERNING BODY OF
THE CITY OF EUDORA, KAN-
SAS:

SECTION I. That Chapter
XV, Article 10, Section
15-1001 of the code of the
City of Eudora, Kansas, is
hereby amended to read
as follows (with the under-
lined language below be-
ing added to the section):

15-1001. Utility Billing.
(a) All bills and ac-
counts for water, sanitary
sewer, and electrical util-
ity services shall be due
and payable by no later
than the date shown on
the bill or invoice (or, in
the event no date is
shown, by the 10th day of
each calendar month). If
full payment is not re-
ceived by the due date,
then such bill or invoice
shall be delinquent, in
which event a late pay-
ment fee of 10% shall be
added to the delinquent
bill and shall also be due
and payable. If full pay-
ment, excluding the late
payment fee, is not re-
ceived within 10 days after
the due date (or, the 20th
day of each calendar
month, if no due date is
shown), then the city may
disconnect or discontinue
the applicable utility serv-
ice in accordance with this
article. In addition, the
utility customer shall pay
any and all charges related
to the reasonable costs of
collection, including but
not limited to court costs,
reasonable attorneys'
fees, and collection
agency fees (provided,
that costs of collection
shall not include both at-
torneys' fees and collec-
tion agency fees). The city
shall provide a summary
of the delinquency and ter-
mination procedures on
the monthly bill or subse-
quent communications.
(b) Any utility customer
who is aged 65 years or
older and dependent on
Social Security may re-
quest that fees for late
payment be waived. Such
a customer must submit to
the city clerk's office a let-
ter from the Social Secu-
rity Administration stating
the date on which the
customer's monthly pay-
ment is sent or scheduled
to be received. If that date
falls after the due date
provided above, then the
city may grant a waiver of
such late payment fees;
provided, that if full pay-
ment is not received
within 10 days after the
due date (or, the 20th day
of each calendar month, if
no due date is shown),
then the city may still dis-
connect or discontinue the
applicable utility service in
accordance with this arti-
cle.

SECTION II. This ordi-
nance shall be in full force
and effect from and after
its adoption and publica-
tion as provided by law.

WHEREAS, historically the
Baldwin City Water Utility
Fund has billed customers
based on the consumption
of water measured in cu-
bic feet: and

WHEREAS, water pur-
chased from the City of
Lawrence is billed to the
City in gallon units: and

WHEREAS, the Governing
Body has determined that
measuring consumption
in gallons would be more
useful and understandable
to the customers served:
and

WHEREAS, there are 748
gallons in 100 cubic feet:
and

WHEREAS the current
water consumption rate of
$7.53 per one hundred cu-
bic feet is equal to a rate
of $10.07 per thousand gal-
lons.

NOW, THEREFORE, BE IT
ORDAINED BY THE GOV-
ERNING BODY OF THE CITY
OF BALDWIN CITY, KAN-
SAS:

SECTION 1.
Section 15-121(a) of the
Code of the City of Baldwin
City, Kansas shall be
amended to read as fol-
lows:

For all retail users of water

for any actual or estimated
amount of water con-
sumed each monthly bill-
ing period (or the Sewer
Average as defined in Sec-

such an average has been
established), a unit charge
of $8.38 per thousand gal-
lons of water consumed.

SAS, REPEALING EXISTING
CHAPTER 1, ARTICLE 22 OF
THE CODE OF THE CITY OF
LAWRENCE, KANSAS, 2015
EDITION, AND AMEND-
MENTS THERETO, PERTAIN-
ING TO THE ECO2 COMMIS-
SION.

BE IT ORDAINED BY THE
GOVERNING BODY OF THE
CITY OF LAWRENCE, KAN-
SAS:

SECTION 1. Existing Chap-
ter 1, Article 22, of the
Code of the City of Law-
rence, Kansas, 2015 Edi-
tion, and amendments
thereto, is hereby repealed
in its entirety.

SECTION 2. This ordinance
shall take effect and be in
force after its passage and
publication as provided by
law.
