RESOLUTION NO. 17-24

A RESOLUTION ADOPTING AN AMENDED AND
RESTATED DOUGLAS COUNTY SANITARY CODE

WHEREAS,
K.S.A. 19-3702 authorizes the Board of
County Commissioners of Douglas County, Kansas (the
"Board") to adopt a sanitary code or codes to apply to
the unincorporated areas of Douglas County, Kansas,
for the control of those environments and environmen-
tal conditions that may adversely affect the health and
well-being of the public;

WHEREAS, pursuant to K.S.A. 19-3702, by Resolution No.
08-44, the Board has previously adopted the current
version of Douglas County Sanitary Code;

WHEREAS, the Board believes the public safety, health
and welfare will be served by the adoption of the pro-
posed amended and restated Douglas County Sanitary
Code;

WHEREAS, the Secretary of Health and Environment of
the State of Kansas has reviewed and, on April 13, 2017,
approved the proposed amended and restated Douglas
County Sanitary Code;

WHEREAS, a notice of the public hearing in conform-
ance with K.S.A. 19-3704 was published in the official
Douglas County newspaper once a week for three con-
secutive weeks, with the last published notice occurr-
ing on June 23, 2017, providing notification of a public
hearing to be held before the Board on July 12, 2017, to
afford interested parties an opportunity to be heard ei-
ther in favor or in protest of the proposed amended and
restated Douglas County Sanitary Code, with the last
date of publication being not less than 10 but not more
than 30 days prior to the date of the public hearing;

WHEREAS, a public hearing was held before the Board
on July 12, 2017, at which hearing all interested parties
were provided an opportunity to be heard either in fa-
vor or in protest of the proposed amended and restated
Douglas County Sanitary Code; and

WHEREAS, after conclusion of the public hearing on
July 12, 2017 and after hearing statements and evidence
presented by all interested parties, the Board desires to
adopt and enact the proposed amended and restated
Douglas County Sanitary Code, to supersede and re-
place the current version of the Douglas County Sani-
tary Code in its entirety.

NOW, THEREFORE, be it resolved by the Board of
County Commissioners of Douglas County, Kansas,
meeting in regular session this 12th day of July, 2017
does hereby resolve as follows:

Section 1. Declaration of Necessity. The Board of
County Commissioners of Douglas County, Kansas (the
"Board") declares that the proposed Douglas County
Sanitary Code is necessary for the protection of the
health and welfare of the public.

establishes a $30 fine for
any adult failing to prop-
erly wear a seatbelt while
in a moving passenger car
and a $60 fine for anyone
between the ages of 14
and 18 failing to wear one.

AN ORDINANCE AMENDING
ORDINANCE 1055,
SECTION 182.1 OF THE
"STANDARD TRAFFIC ORDI-
NANCE FOR KANSAS
CITIES," EDITION OF
2016, TO COMPLY WITH
KANSAS STATE STATUTE.

WHEREAS, current Stand-
ard Traffic Ordinance Sec-
tion 182.1 requires Munici-
pal Court to impose a $10
fine for seat belt viola-
tions; and

WHEREAS, effective July 1,
2017, Kansas Senate Bill 89
requires Municipal Court
to impose a $30 fine for
seat belt violations, and
submit $20 of that fine to
the state; and

WHEREAS, the City of Eu-
dora Governing Body de-
sires to amend the fine
portion of Section 182.1 of
the Standard Traffic Ordi-
nance to comply with this
requirement.

NOW, THEREFORE, IN CON-
SIDERATION OF THE A-
FORESTATED PREMISES, BE
IT ORDAINED BY THE GOV-
ERNING BODY OF THE CITY
OF EUDORA, KANSAS:

Section 1. AMENDMENT.

Pursuant to Kansas Senate
Bill 89, Section 182.1(d) of
the 2016 Standard Traffic
Ordinance for Kansas Cit-
ies, adopted by reference
in the City of Eudora by Or-
dinance 1055, is hereby
amended to read as fol-
lows:

(d)(1) Persons violating
subsection (a)(1) shall be
fined $30 and no court
costs;

As required by Kansas
State Statute 12-4120(c),
on and after the effective
date of this Ordinance, the
amount of $20 from each
fine imposed for a viola-
tion of 2016 Standard Traf-
fic Ordinance for Kansas
Cities, Section 182.1(a)(1)
shall be remitted by the
Municipal Court Clerk to
the state treasurer.

Section 2:EFFECTIVE DATE

The City Clerk shall make
proper publication of this
Ordinance, which shall be
published once in the offi-
cial city newspaper and
which shall be effective
from and after said publi-
cation. The City Clerk is di-
rected to attest to and af-
fix the Official Seal of the
city thereon.
