PUBLIC NOTICE

DATE OF THIS NOTICE: April 19, 2012

PURPOSE OF THIS NOTICE: The U.S. Environmental Protection Agency (EPA) is announcing its proposed determination of Corrective Action Complete without Controls under
the Resource Conservation and Recovery Act, as amended (RCRA), for former
Safety-Kleen Systems, Inc. facility #508501 (facility). Corrective Action Complete without Controls means that, as of the date of this notice, the facility owner/operator has
satisfied RCRA corrective action obligations. Based on available information, the EPA
is not aware of any environmental releases of hazardous constituents at the facility at
levels that present a potential threat to human health or the environment. The EPA is
taking comments on our proposal that no further environmental cleanup is necessary
at this facility. The EPA will make a final decision after considering all comments, consistent with applicable RCRA requirements and regulations. If the decision is substantially unchanged from the one in this notice, EPA will issue a final decision and inform
all persons who submitted written comments or requested notice of EPA's final determination. If the final decision is significantly different from the one proposed, EPA will
issue a public notice explaining the new proposed decision and will reopen the comment period.

FACILITY DESCRIPTION: The facility operated from 1976 to 1986. The facility submitted
a RCRA Part A Permit Application to store spent hazardous waste solvents in 1980.
Wastes stored at the facility were primarily spent parts washing solvents. The facility
submitted a closure plan in September 1985, and the Kansas Department of Health and
Environment (KDHE) approved a modified plan in June 1987. Hazardous waste storage
operation closure activities in 1987 and 1988, included decontamination of a drum storage area located inside a warehouse on site, removal and decontamination of a solvent return/fill station, and removal of two solvent underground storage tanks (USTs)
along with approximately 1,200 cubic yards of contaminated soil. Soil sampling results
indicated that residual contamination remained in the UST area after the excavation
and closure activities were completed.

KDHE evaluated other solid waste management activities at the facility in a report
dated February 1989. KDHE identified the need for a RCRA Post-Closure Permit to address residual contamination in the UST area and the former return/fill station. The facility submitted a Post-Closure Plan along with a RCRA Part B Post-Closure Permit Application in July 1990. The Post-Closure Plan included construction of concrete cover
over the former UST area, grading of the site, and the filing of a deed notice of environmental conditions at the property. Routine groundwater monitoring conducted by the
facility from 1990 to 1994, demonstrated that no contamination was present in groundwater above drinking water standards. In 1995, the facility re-sampled subsurface soil
and demonstrated no contamination remained in soil. In a letter dated October 16,
1995, KDHE terminated the facility's post-closure care requirements and terminated
their interim status permission to operate as a hazardous waste storage facility. For

COMMENT PROCESS: Persons wishing to comment on EPA's proposed decision of Corrective Action Complete without Controls must submit comments to EPA within the
30-day comment period ending May 21, 2012. Interested persons may also request a
public hearing on this proposed decision. All comments and/or requests for a hearing
must be submitted in writing via mail, fax, or email to the EPA Project Manager Kurt
Limesand, as listed below, and must be received prior to May 21, 2012. All comments
will be considered in making a final decision.
